Boater capsizes three times before drunk-boating arrest

A Key West man was jailed this week for drunken boating after the Florida Fish and Wildlife Conservation Commission said he capsized his Hobie Cat catamaran twice while off Fort Zachary Taylor State Park.

Justin Ashley also overturned the sailboat in the main ship channel Tuesday, FWC reported.

Ashley, 28, had a .12 blood-alcohol content about three hours after being taken off the water, according to police. In Florida, .08 is legally drunk.

Friday, Ashley remained locked up at the Marathon jail on $10,000 bond.

FWC Lt. Josh Peters said Ashley, who works at a watersports company, was screaming and incoherent when taken into custody on the water and refused to take a breath-alcohol test until later.

"He was so drunk, Lt. Peters couldn't even understand his name," said Officer Robert Dube, FWC spokesman.
